By accessing or using our website or purchasing from us, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

You represent that you are at least the age of majority in your state of residence.

We reserve the right to update these Terms at any time. Continued use of the Services constitutes acceptance of any changes.


1. Products & Services

Product Availability

All products, pricing, features, and specifications are subject to change without notice. Products may be available in limited quantities.

We reserve the right to:
• Limit quantities
• Refuse service
• Cancel orders
• Discontinue products

Accuracy of Information

We strive for accuracy; however, product descriptions, colors, weights, and pricing may occasionally contain errors. We do not guarantee that all information is complete, current, or error-free.

In the event of a pricing or listing error, we reserve the right to cancel affected orders.


2. Accounts

You may be required to create an account to access certain features.

You agree to:

• Maintain account security
• Be responsible for activity under your account

We may suspend or terminate accounts at our sole discretion.

Electronic communications from us satisfy any legal requirement that communications be in writing.


3. Orders, Cancellations & Promotions

Order confirmations do not constitute final acceptance. We may require additional verification before fulfilling an order.

Orders may be canceled only if tracking has not yet been issued. Approved cancellations receive store credit only.

We may limit or refuse promotional codes at our discretion.


4. Shipping

Shipping times are estimates and not guarantees. Risk of loss transfers to you once the carrier marks the package as delivered.

SunnyBrook Co. is not responsible for:
• Carrier delays
• Lost or stolen packages after confirmed delivery
• Incorrect shipping information provided by the customer

Customers are responsible for any customs fees or import duties.

5. Returns & Store Credit Policy

All returns are subject to our Returns & Exchanges Policy.

We do not offer refunds to the original form of payment.

Approved returns receive:
• Replacement, or
• Store credit

Customers are responsible for return shipping costs.

Used, burned, custom, sale, or final-sale items are not eligible for return.

SunnyBrook reserves the right to deny returns that do not meet policy requirements.


6. Payment

Payments are processed through third-party payment processors (including Shopify and related providers).

We are not responsible for payment processor errors.

By submitting payment, you authorize us to charge the full purchase amount.


7. Intellectual Property

All content on this website — including logos, product names, images, designs, text, graphics, and branding — is the exclusive property of SunnyBrook Co.

You may not reproduce, copy, distribute, modify, or use our content without written permission.


8. Prohibited Use

You agree not to:

• Violate laws
• Attempt to hack, scrape, or disrupt the site
• Transmit viruses or malicious code
• Impersonate another individual
• Use our content without authorization

We may suspend or terminate access for violations.

Your sole remedy if dissatisfied is to discontinue use of the Services.


10. Limitation of Liability

To the maximum extent permitted by law, SunnyBrook Co. shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Our total liability shall not exceed the amount paid by you for the product at issue or $100, whichever is greater.

Some states do not allow certain limitations, so portions of this section may not apply.


11. Indemnification

You agree to defend, indemnify, and hold harmless SunnyBrook Co. from any claims arising from:

• Your violation of these Terms
• Your misuse of products
• Your violation of any law or third-party rights


12. Governing Law

These Terms are governed by the laws of the State of Mississippi, without regard to conflict of law principles.

Any dispute not subject to arbitration (see below) shall be brought exclusively in courts located in Mississippi.


13. Arbitration & Dispute Resolution

PLEASE READ CAREFULLY.

You agree that any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration, not court litigation.

Arbitration will be conducted confidentially under the rules of the American Arbitration Association.

You waive the right to a jury trial or participation in class actions.

If arbitration is deemed unenforceable, disputes shall be resolved in Mississippi courts.

15. General Provisions

If any provision is deemed invalid, the remaining provisions remain enforceable.

Failure to enforce any right does not constitute waiver.

These Terms constitute the entire agreement between you and SunnyBrook Co.
